By accessing and using the Design Arc Academy website and/or enrolling in any of our courses, you acknowledge that you have read, understood, and agree to comply with and be bound by these Terms and Conditions.
1. Acceptance of Terms
By accessing and using the Design Arc Academy website, services, learning platform, or enrolling in any of our courses, you agree to comply with and be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you should not access our services or enroll in our courses.
2. Course Enrollment
2.1 Eligibility
To enroll in our courses, you must be at least 18 years of age or have the consent of a parent or legal guardian.
2.2 Payment
Payment for courses must be made in accordance with the pricing, payment terms, and policies specified by Design Arc Academy at the time of enrollment.
Enrollment is considered confirmed only after the applicable course fee has been successfully received by Design Arc Academy, unless otherwise communicated by us.
3. Course Validity and Access
3.1 Course Validity
Unless otherwise specified for a particular course, your course enrollment and access shall remain valid for a period of one (1) year from the date of enrollment/payment.
After the expiry of the one-year validity period, Design Arc Academy reserves the right to discontinue or restrict access to the course, learning management system, course materials, recordings, student groups, and other course-related resources.
3.2 No Automatic Extension
Course access will not automatically be extended beyond the one-year validity period. Any extension, if offered, shall be entirely at the discretion of Design Arc Academy and may be subject to additional terms or charges.
4. Intellectual Property
4.1 Content Ownership
All course materials, including but not limited to text, videos, recordings, images, presentations, documents, assignments, notes, graphics, designs, software resources, and other educational content provided by Design Arc Academy are the intellectual property of Design Arc Academy and/or its respective content owners and are protected under applicable intellectual property and copyright laws.
4.2 License
By enrolling in a course, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the course materials solely for your personal, educational, and non-commercial purposes during the applicable course validity period.
You may not reproduce, distribute, publish, sell, sublicense, share, upload, transmit, modify, commercially exploit, or otherwise make course materials available to any third party without prior written permission from Design Arc Academy.
5. Live Classes and Recorded Content
5.1 Nature of Course Fees
The course fee primarily covers the live instructional classes, teaching, faculty interaction, guidance, and associated educational services provided as part of the enrolled course.
5.2 Supplementary Recorded Content
Recorded classes and other recorded educational materials may be provided by Design Arc Academy as a supplementary learning resource and are not intended to replace the live classes.
The availability, format, duration, or specific content of recorded materials may vary depending on the course and circumstances.
5.3 Edited and Curated Recordings
Where recordings of live classes are provided, Design Arc Academy may provide edited, cleaned, or curated versions of such recordings.
Such recordings may be prepared by removing or minimizing irrelevant discussions, unnecessary interruptions, technical issues, unrelated questions, excessive background noise, or other content that is not directly relevant to the core topic, procedure, or learning objective.
The purpose of providing such curated recordings is to provide students with a cleaner and more focused learning resource that makes it easier to revise, recall, and understand the relevant course content.
Accordingly, a recording may not necessarily contain every discussion, question, interaction, or exchange that occurred during the corresponding live class.
5.4 Recording Availability
Design Arc Academy does not guarantee that every live class will be recorded, edited, uploaded, or made available for a specific duration. Recording availability may be affected by technical issues, instructor availability, platform limitations, copyright considerations, or other circumstances.
6. Refund and Cancellation Policy
Please refer to our Cancellation and Refund Policy for information regarding refunds, cancellations, eligibility, and applicable conditions.
7. Privacy Policy
Your use of the Site and our services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.
8. Code of Conduct
Students are expected to maintain professional, respectful, and appropriate conduct while participating in classes, interacting with faculty, communicating with fellow students, using our learning platforms, and participating in official student communication groups.
You agree not to engage in activities including, but not limited to:
- Harassment, bullying, intimidation, or threatening behaviour.
- Abusive, offensive, discriminatory, or disrespectful communication.
- Misconduct toward faculty, staff, or fellow students.
- Repeatedly asking questions or posting content that is irrelevant to the course or discussion.
- Posting unnecessary, excessive, misleading, inappropriate, or unrelated content in official student groups or platforms.
- Disrupting classes or interfering with the learning experience of other students.
- Plagiarism, unauthorized copying, distribution, or misuse of course materials.
- Sharing confidential course information or private communications without authorization.
- Any other conduct that Design Arc Academy reasonably considers inappropriate, disruptive, unethical, or detrimental to the learning environment.
9. Disciplinary Action and Termination of Access
Design Arc Academy reserves the right to take appropriate action if a student violates these Terms and Conditions or engages in behaviour that negatively affects the learning environment.
Depending on the nature and severity of the conduct, Design Arc Academy may, at its discretion and without being required to provide prior notice:
- Issue a warning or instruction to discontinue the conduct.
- Restrict or suspend access to certain course resources or communication channels.
- Remove the student from official WhatsApp groups or other student communication groups.
- Suspend or terminate the student’s course access.
- Terminate the student’s enrollment and access to the Site, LMS, course materials, recordings, or other services.
Such action may be taken in cases involving irrelevant or excessive questioning, unnecessary content sharing, disruption of classes, inappropriate communication, misconduct with fellow students or faculty, harassment, abuse, plagiarism, unauthorized sharing of course content, or any other behaviour that Design Arc Academy considers inappropriate or detrimental to the course or its community.
Where access or enrollment is terminated due to a violation of these Terms and Conditions, the student shall not be entitled to a refund unless otherwise determined by Design Arc Academy in its sole discretion.
10. Disclaimer
Design Arc Academy provides courses and educational resources for educational and informational purposes only.
We do not guarantee any specific academic, professional, employment, financial, business, or other outcome as a result of completing any course.
Design Arc Academy shall not be responsible for any decisions, actions, results, losses, or consequences arising from the use of information, techniques, resources, or knowledge provided through our courses.
11. Job, Internship, and Freelance Work Disclaimer
Design Arc Academy does not provide any guarantees or assurances regarding job placement, internship opportunities, freelance work, or employment as a result of enrolling in or completing any course.
While we may provide career-related guidance, resources, opportunities, or information, we do not guarantee employment or any specific job, internship, freelance project, client, income level, or professional outcome.
Any decisions or actions related to job searches, internships, freelance work, employment, or client engagements are solely the responsibility of the individual student.
12. Job Portal and Application Disclaimer
Design Arc Academy may provide access to a job portal, job listings, internship opportunities, or freelance opportunities for the convenience of students.
However, Design Arc Academy does not endorse or guarantee the accuracy, legitimacy, authenticity, availability, suitability, or quality of any job, internship, employer, client, or freelance opportunity posted or shared through such channels.
Students are advised to independently verify and conduct appropriate due diligence regarding any opportunity before applying, communicating with an employer or client, sharing personal information, or entering into any agreement.
Design Arc Academy shall not be responsible for any consequences, including but not limited to the outcome of job applications, communications or interactions with potential employers or clients, financial losses, disputes, employment conditions, contractual matters, or issues arising during or after employment or freelance engagements.
13. Software Installation and Device Disclaimer
Design Arc Academy may offer assistance with the installation of software required for certain courses as a service to students.
While we strive to provide accurate instructions and reasonable support, we do not guarantee the successful installation, configuration, compatibility, or functioning of any software on a student’s device.
Design Arc Academy expressly disclaims responsibility or liability for any damage, data loss, security issue, malfunction, performance issue, or other problem affecting a student’s device, including but not limited to laptops, desktops, tablets, iPads, or other electronic devices, that may occur during or as a result of the software installation or configuration process.
It is the student’s responsibility to ensure that their device meets the applicable system requirements and to maintain appropriate backups of important data before installing or modifying any software.
Design Arc Academy shall not be responsible for any costs, repairs, replacements, data recovery, or other expenses arising from software installation or configuration.
14. Course Schedule and Details Modification
Design Arc Academy reserves the right to modify the course schedule, start date, class timings, duration, curriculum, course content, instructors, delivery format, and any other course-related details at its discretion.
While we make reasonable efforts to provide accurate and timely information, unforeseen circumstances, instructor availability, operational requirements, technical limitations, or necessary improvements may require adjustments to course offerings.
We will make reasonable efforts to communicate material changes to enrolled students through appropriate official communication channels.
However, it remains the student’s responsibility to regularly check for updates and modifications to course details through the Design Arc Academy website, LMS, WhatsApp groups, email, or other official communication channels.
By enrolling in a course, you acknowledge and accept that Design Arc Academy may make reasonable modifications to course-related information and agree to abide by such changes.
15. Use of Student Work and Photographs
Design Arc Academy may request students to voluntarily share their assignment work, projects, photographs, testimonials, or other submitted materials for the purpose of showcasing student achievements, educational purposes, and promoting Design Arc Academy and its courses.
By voluntarily submitting such work or photographs for these purposes, you grant Design Arc Academy a non-exclusive, worldwide, royalty-free right to use, reproduce, display, publish, distribute, and otherwise use the submitted materials for promotional, marketing, educational, and informational purposes.
Participation is voluntary, and students are not obligated to provide such materials.
If you choose to share your work or photographs, you do so willingly and without any expectation of compensation.
While Design Arc Academy will make reasonable efforts to protect materials shared by students, we cannot guarantee protection against unauthorized copying, use, redistribution, or misuse by third parties.
By voluntarily sharing your work or photographs, you acknowledge and accept the associated risks of third-party use.
16. Changes to Terms
Design Arc Academy reserves the right to update, amend, or modify these Terms and Conditions from time to time.
Any updated Terms and Conditions may be posted on the Site, and the revised version shall become effective from the date specified therein or, where no date is specified, upon publication.
It is the student’s responsibility to periodically review the Terms and Conditions for any changes.
